MINUTES OF THE PUBLIC MEETING OF JANUARY 24TH, 2006

Called to Order at 7:30 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5. by Philip Lindquist, Chairman, in Meeting Room A on the top floor at the Town Hall.

Appointments

7:45 PM  Appointment with Sheila Niksa to discuss ongoing issues at Tag Way (DEP #SE175-341)

Debra Brennock and Attorney, Robert Marzelli attended to dispute the Commission’s comments initiated by a Request for Certificate of Compliance by the owner of Tag Way, Sheila Niksa.   Ms. Delaney had reviewed the file extensively and advised that the Commission not approve the roadway and associated drainage structures unless the subdivision has been completed in accordance with the approved plan.  The most important issue was the detention basin which presently holds water, has wetland characteristics and has not been maintained.  There is also scouring and erosion in the basin.  The erosion control (haybales & stakes) should be removed and several other issues have been unresolved.  Ms. Delaney suggested that she be allowed to talk with John Delano, the Engineer.  Ms. Brennock agreed.  A letter from Richard Harris, Highway Surveyor, was read into the record.  He concurred that the detention basin was possibly installed incorrectly and the Highway Department would not accept responsibility for it in its present condition.  

Public Hearings

8:00 PM Notice of Intent for the construction of an addition to an existing dwelling and associated site work at 287 Indian Head Street, Assessors Map 47, Lot 7-1-R for Donald Colby represented by Webby Engineering, 180 County Rd., Plympton, MA  (DEP #175-___) (New Hearing)

David Harris read the Public Hearing Notice and the abutters were verified.  Ms. Sharon LePorte, the representative for Webby Engineering made a presentation for a proposal for an addition.  It is out of the 50-foot No Disturb Zone.  A silt fence is proposed.  The area is flat.  Ms. Delaney had inspected

the site.   Presently, the DEP is asking for a USGS map and had not issued an identifying number. Per policy of the Commission, the project will not be approved until such number is received.

8:15 PM  Continued  Request to Amend an Order of Conditions to allow a modification to relocate garages at 255 Rear Liberty Street, Assessors Map 82, Lot 6-1 for Dennis Leary, Trustee for Hudson Park Associates, N.T., 2 Columbia Rd., Pembroke, MA  02359   (DEP #175-0433)  - continued to February 14th at 8:00 PM per request of applicant

8:30 PM  Notice of Intent for the construction of an addition to an existing dwelling and a septic repair at 263 Woodbine Ave., Map 2, Lot 42, 43 for John Barilaro represented by Grady Consulting, LLC, 6 Grays Beach Rd., Kingston, MA  (DEP #175-0488)  (New Hearing)

Dave Harris read the Public Hearing Notice and the abutters were verified.  Gary Walcott from Grady Engineering made the presentation for a proposal for an addition and septic repair.  The wetland had been delineated by Cassady Consulting.  The new septic system and leaching field was out of the 100-foot buffer zone.  However, some grading for construction of the garage and addition was within the 50-foot no build setback.  The proposal called for haybales as mitigation against any erosion. Mr. Grattan asked if the addition could be moved to meet the 50-foot setback requirement.  Mr. Barilaro replied, yes, it could be moved.  Also, Ms. Delaney suggested that as mitigation for work within the buffer zone, the area is tidied up, i.e.: clean up the woods of cars, car parts, etc.

8:45 PM  WHRHS  and representatives (see letter of 1/19/06 from Agostini Construction)

In attendance were:  Mary Mahoney, Ted Gentry Associates, Inc., Steve Agostini, Agostini Construction Co., Inc., Darren Sawyer, Architecture Involution, LLC and Donald Richard of John G. Crowe Associates Inc..  The Commission had asked all parties to attend to address an Enforcement Order issued on January 10th, 2006 to Agostini Construction Co. & Northeast Contractors for violating the Order of Conditions and directives of the Conservation Commission resulting in flooding and siltation of wetlands.  The Commission requested an update on the status of any corrective measures that have been implemented as outlined in the Enforcement Order.  Mr. Lindquist voiced his concern that the flooding is creating a dangerous situation for the public and stressed that something should be done immediately to rectify the situation.  Ms. Mahoney, the project manager, said that procedure must be followed.  The Building Committee is meeting on February 2nd and will go over the change orders and vote.  In the meantime, Mr. Richard said that as a temporary measure, the catch basins in

the front of the school will be lowered tomorrow so as to catch more of the runoff.  Ms. Delaney asked about the detention basins, are they wet or dry?  Mr. Richard answered that the large basin should be dry.  He asked the contractor to clean the stone in the lower basin, and eventually change the grade if necessary.  A check dam has to be removed and that will take care of the retention of water.  Phil Lindquist questioned the location of the Vortex unit.  Ms. Delaney questioned the functionality and the cleaning of the unit.   The replacement of the culvert beneath the walkway and stream crossing standards were discussed.  Mr. Lindquist suggested a two-month time limit to get things done and warned that fines could be levied.  He asked for a monthly report from Ms. Mahoney.  

9:00 PM  Conservation Parcel Photo Record  -  An appointment had not been scheduled with Phil Clemons, however, Ms. Delaney relayed to the Commission that he intended to download and index photos of Conservation and Town owned land onto the computer.

9:15 PM  81 Ocean Avenue – The Commission met with Kevin Smith briefly and advised him if he has more than one activity planned, he should file them both on one Notice of Intent rather than on two as it would save time and money.

Member Vacancy -  Mr. Lindquist made a plea to television viewers that there is a vacancy on the Commission and all interested parties should apply in the Selectman’s Office.
Woodbine Easement – Ms. Delaney will try to contact owner to have him removed the “tent” from the easement.
Agent Evaluation – The Commission Members are extremely satisfied with Ms. Delaney’s performance and will submit a review to Executive Secretary, Mike Finglas stating as much.
